Outcome: Planning Permission for circa 10 dwellings secured on appeal and costs awarded against the Council.
Acting on behalf of a local landowner, WBW sought Planning Permission for circa 10 dwellings on a Green Field Site. Despite being outside of the current settlement boundary, WBW were able to convince the Council’s Planning Officers to support the development.
Due to local opposition, elected Councillors would not approve the application. WBW prepared and submitted an appeal against the refusal to the Planning Inspectorate and also made a claim for costs against the Council for unreasonable behaviour. The Planning Inspector allowed the development on appeal and the Council was ordered to pay the full costs of the applicant as it had acted unreasonably.
